April 11th Foodservice Equipment Auction

All bidders must register AND must be at least 18 years of age with a valid driver's license to bid.

The auctioneer, at all times, reserves the right to:  A) Reject any bid or disqualify any bidder due to financial or other reasons. B) Revoke the bidding privileges of any bidder. C) Bid as agent on behalf of any Absentee Bidder. Absentee bids will be accepted; however, the highest bidder shall be the buyer at the hammer price and any dispute shall be settled at the Auctioneer's absolute discretion. Once the auctioneer indicates "Sold" the responsibility of the equipment becomes that of the successful bidder.

All merchandise is sold "as is, where is" without any warranty from Floyds Prime Equipment Inc. expressed or implied  in any form whatsoever.  All sales are final.   A 12% Buyers Premium will be added to all onsite winning bids. Online bidders will be charged a 15% Buyers Premium.  A 2% discount will be given for cash invoices. 8.25% Sales Tax will be added to all purchases.   DEALERS must provide re-sale certificate. All purchases must be paid-in-full day of auction before removal from auction site. Only Visa, MasterCard, Discover, Cash accepted.

Persons, while attending the auction, and/or during the removal of goods from the premises, assume all risk for personal and/or property damage.  Therefore, neither the Auction Company nor its Principal shall be liable by reason of a defect in or of the condition of the premises at which the auction is held. Bidder does hereby indemnify and hold harmless auctioneer and Seller from any and all damage, claims, or liabilities from injuries to persons or property of any type whatsoever, caused before, during or after the auction.

ALL buyers agree to be responsible for the removal of purchased items from the auction location by 5pm CST April 17, 2009. Any item not removed from the auction site by 5pm CST April 17 will be considered abandoned and can be disposed of (including resell) at the auction company's discretion and all monies forfeited. 

Announcements sale day supersede any and all previously published or oral information released prior to sale. This auction is governed exclusively by the State of Texas, jurisdiction of Wood County. TL16037

  Prime Equipment & Auction Company is located in the heart of East Texas, about 100 miles from Dallas, Shreveport or Texarkana at the intersection of State Highways 154 & 37, behind the Dairy Queen on S 37 next to Jim Hogg City Park.On South Hwy37 as entering/leaving town, turn west on Richards Street beside the DQ drive-thru and immediately turn right on McAllister. Our warehouse is the only thing on the right surrounded by a fence.  Entrance is by the park and across the street from the Carroll Green Civic Center.
